Welcome to 3D Shards. These Terms and Conditions (“Terms”) govern your access to and use of the 3D Shards website, marketplace, products, downloads, account features, seller tools, community areas, and related services (“Services”).
By accessing or using our Services, creating an account, purchasing digital content, uploading content, or selling through 3D Shards, you agree to these Terms, our Privacy Policy, our Refund and Returns Policy, and our 3D Content Licensing Agreement.

1. About 3D Shards
3D Shards is a digital marketplace for 3D assets, Daz3D-compatible products, models, textures, images, presets, and other digital content.
Some products may be created and uploaded by independent creators or sellers (“Sellers”). Sellers retain ownership of their own content and are responsible for ensuring that their uploaded products, descriptions, previews, and related materials comply with applicable laws and do not infringe third-party rights.
When you purchase a product on 3D Shards, you are not buying ownership of the digital asset. You are purchasing a limited license to use the digital content according to the applicable license terms.
2. Digital Products and Downloads
All products offered on 3D Shards are digital products delivered electronically.
Digital products may include, but are not limited to, instantly downloadable 3D assets, models, textures, files, presets, images, documentation, and related digital materials.
After a successful purchase, access to the digital product may be provided through your account, download page, order confirmation, or another electronic delivery method.
You are responsible for ensuring that your device, software, internet connection, and compatible applications are suitable for downloading and using the purchased digital products.
3. Account Requirements
To purchase, download, upload, sell, or access certain features, you may need to create an account.
You agree to:
- provide accurate and up-to-date information;
- keep your login credentials secure;
- notify us if you suspect unauthorized access to your account;
- take responsibility for all activity under your account;
- not transfer, sell, or share your account without our permission.

A purchase is completed only after successful payment confirmation. We may refuse, cancel, or review orders if we detect suspected fraud, payment issues, technical errors, pricing errors, or policy violations.
6. Refunds, Returns, and Right of Withdrawal
Our products are digital content delivered electronically. Refunds, returns, withdrawal rights, and exceptions for instantly downloadable digital products are governed by our Refund and Returns Policy.

7. Licenses and Permitted Use
Purchases on 3D Shards grant you a limited license to use the purchased digital content under the applicable 3D Content Licensing Agreement or product-specific license terms.
Unless expressly allowed by the applicable license, you may not:
- resell, redistribute, share, sublicense, or upload the original product files;
- claim ownership of the original digital asset;
- extract and redistribute parts of the product as a competing asset;
- use the product in a way that violates applicable laws or third-party rights;
- bypass or remove license information, copyright notices, or technical restrictions.
Different products may be subject to different license terms. It is your responsibility to review the applicable license before using a product.
8. Seller Content and Marketplace Responsibility
Sellers are responsible for the products, descriptions, preview images, documentation, and other materials they upload to 3D Shards.
By uploading or submitting content to 3D Shards, Sellers confirm that they have all necessary rights, licenses, permissions, and authorizations to distribute that content through our marketplace.
Sellers agree that their uploaded content must not:
- infringe copyright, trademark, privacy, publicity, or other third-party rights;
- contain illegal, harmful, defamatory, abusive, or misleading material;
- contain malware, viruses, or harmful code;
- depict minors in inappropriate contexts;
- violate applicable laws or platform policies.
We may review, remove, restrict, suspend, or disable content, products, listings, or accounts if we believe they violate these Terms, applicable laws, third-party rights, or marketplace safety standards.
9. Your Content
“Your Content” means any content you upload, post, submit, sell, display, or otherwise make available through 3D Shards, including products, files, text, images, comments, reviews, forum posts, and profile information.
You retain ownership of Your Content. However, by submitting Your Content to 3D Shards, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, promote, modify for technical purposes, and distribute Your Content as necessary to operate, improve, market, and provide the Services.
This license allows us to display product previews, promote listings, process downloads, operate the marketplace, and make your content available to users according to the applicable product and license settings.
10. 3D Shards Content
The 3D Shards name, logo, website design, text, graphics, software, branding, and other platform materials are owned by or licensed to 3D Shards.
You may not copy, reproduce, distribute, modify, sell, exploit, or use our platform content, branding, or trademarks without our prior written permission, except as expressly allowed by law or by these Terms.
11. Intellectual Property Claims
We take intellectual property rights seriously.
If you believe that content on 3D Shards infringes your copyright, trademark, or other rights, please contact us and provide sufficient information for us to review the claim.
We may remove or disable access to content that is alleged to infringe third-party rights. Repeat infringers may have their accounts suspended or terminated.
If a product is removed due to an intellectual property claim, access to that product may also be removed from user download areas where necessary for legal compliance.
12. Reviews, Community Features, and Communications
3D Shards may provide forums, reviews, comments, messages, or other community features.
You agree to use these features respectfully and lawfully. We may moderate, edit, remove, or restrict content that we consider abusive, misleading, spam, illegal, infringing, or harmful to the community or platform.
By using our Services, you consent to receive electronic communications related to your account, purchases, downloads, seller activity, legal notices, and service updates.
13. Seller Compensation
If you sell products through 3D Shards, seller compensation, payout thresholds, schedules, fees, taxes, refunds, discounts, chargebacks, and payment adjustments are governed by the seller rules, marketplace settings, and any applicable seller agreement.
Sellers are responsible for providing accurate payment, contact, and tax information.
Refunds, chargebacks, fraud, technical issues, discounts, or policy violations may affect seller earnings. We may withhold, adjust, or reverse seller payments where necessary to handle refunds, disputes, legal claims, suspected fraud, or violations of these Terms.
14. Privacy
Your use of 3D Shards is also governed by our Privacy Policy.

15. Age Requirement
You must be at least 18 years old to use 3D Shards independently.

We are not responsible for third-party websites, content, policies, availability, security, or services. Your use of third-party services is at your own risk and may be subject to separate terms and policies.

3D Shards operates from Hungary.
Users access the Services from different countries and are responsible for complying with any local laws that apply to their use of the Services, purchases, downloads, uploads, sales, and digital content.
18. Availability and Changes to the Services
We may modify, update, suspend, restrict, or discontinue any part of the Services at any time, including products, features, seller tools, download systems, community features, or account functionality.
We aim to keep the Services available and secure, but we do not guarantee uninterrupted, error-free, or permanent access.
19. Termination
You may stop using the Services or request account closure at any time.
We may suspend, restrict, or terminate your account or access to the Services if we believe that you have violated these Terms, applicable laws, third-party rights, marketplace rules, or platform security requirements.
After termination, some provisions of these Terms will continue to apply, including license restrictions, intellectual property provisions, payment obligations, liability limitations, and dispute-related provisions.
20. Disclaimers
The Services and digital products are provided on an “as is” and “as available” basis, except where applicable law provides otherwise.
We do not guarantee that every digital product will be compatible with every device, software version, plugin, render engine, workflow, or user setup unless compatibility is expressly stated in the product description.
Users are responsible for reviewing product descriptions, compatibility information, requirements, previews, and documentation before purchasing.
Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer protection law.
21. Limitation of Liability
To the maximum extent permitted by law, 3D Shards is not liable for indirect, incidental, consequential, special, punitive, or loss-of-profit damages arising from your use of the Services or digital products.
For marketplace products uploaded by independent Sellers, the Seller is responsible for the accuracy, legality, originality, and quality of the uploaded content. However, this does not limit any rights you may have under applicable consumer protection law.
Our total liability for any claim relating to a purchase is limited to the amount paid for the relevant product, unless applicable law requires otherwise.
22. Changes to These Terms
We may update these Terms from time to time.
When we make significant changes, we may notify users by posting the updated Terms on our website, updating the “Last updated” date, or using other reasonable communication methods.
Your continued use of the Services after changes become effective means that you accept the updated Terms.
