3D Shards – Content License Agreement

This Content License Agreement (“Agreement”) explains how digital products purchased or downloaded from 3D Shards may be used.
By purchasing, downloading, accessing, or using any digital product from 3D Shards, you agree to this Agreement, our Terms and Conditions, our Privacy Policy, and our Refund and Returns Policy.
If a product page, Product Attributes section, or product description includes a specific license type or special license terms, those terms apply in addition to this Agreement. If there is a conflict between this Agreement and the product-specific license terms, the product-specific terms will apply for that product.
1. Definitions
3D Shards means the 3D Shards website, marketplace, platform, and related services.
Digital Product or Digital Asset means any digital content made available through 3D Shards, including 3D models, Daz3D-compatible products, textures, presets, materials, morphs, images, documentation, files, and related digital materials.
Product Files means the original downloadable files included with a Digital Product, including models, textures, source files, presets, archives, documentation, and any extracted or modified parts of those files.
Buyer, Customer, User, or Licensee means the person or entity that purchases, downloads, accesses, or uses a Digital Product.
Seller or Creator means the person or entity that uploads, publishes, or sells a Digital Product through 3D Shards.
End Product means a new work created by the Licensee using a Digital Product, such as a render, illustration, animation, video, comic, game scene, promotional image, or other creative project.
2D Output means a flattened or rendered result, such as a still image, render, animation, video, comic page, book cover, poster, or similar non-extractable visual work.
Interactive Project means a game, app, VR/AR project, real-time scene, simulation, virtual production project, or similar project where users can interact with content.
2. Ownership
Digital Products are licensed, not sold.
Purchasing or downloading a Digital Product does not transfer copyright, ownership, or intellectual property rights in the Digital Product to you.
The Seller or relevant rights holder retains ownership of the Digital Product. 3D Shards and/or the Seller grants you only the limited rights expressly described in this Agreement or in the applicable product-specific license.
All rights not expressly granted are reserved.
3. General License Grant
Unless a product page states otherwise, purchasing or downloading a Digital Product grants you a non-exclusive, worldwide, perpetual license to use the Digital Product under the applicable license type.
This license is royalty-free for permitted uses. This means that you do not owe additional royalties to 3D Shards or the Seller for permitted use of the Digital Product.
This license is personal to you or your organization and may not be transferred, resold, sublicensed, shared, or assigned except as expressly allowed by this Agreement.
4. Standard License
Unless a product page or Product Attributes section clearly states that another license applies, Digital Products on 3D Shards are provided under the Standard License.
The Standard License allows you to use the purchased Digital Product to create 2D Outputs, including:
- still renders;
- illustrations;
- comics;
- book covers;
- posters;
- promotional images;
- animations;
- videos;
- visual effects;
- non-interactive rendered content;
- commercial or non-commercial 2D artwork.
You may use these final 2D Outputs for personal or commercial projects.
However, the Standard License does not allow you to share, sell, upload, redistribute, sublicense, or give away the original Product Files, modified Product Files, textures, morphs, presets, or any extractable parts of the product.
You may not use the Product Files, textures, models, morphs, presets, or other asset components to create a competing digital asset, merchant resource, stock asset, 3D model pack, texture pack, morph pack, preset pack, or downloadable product.
If you want to use the actual 3D model, textures, morphs, presets, or other Product Files inside a game, app, VR/AR project, interactive experience, simulation, or another distributed project, you need an Extended License or written permission.
5. Editorial License
Some Digital Products may be marked as Editorial, Editorial Use Only, or similar.
An Editorial License means the product may only be used for personal, educational, commentary, review, portfolio, or other non-commercial editorial purposes.
Editorial products are usually not suitable for commercial use because they may be inspired by, reference, or include elements connected to third-party intellectual property, brands, characters, fan art, real-world designs, or similar protected material.
With an Editorial License, you may create personal renders, practice artwork, portfolio images, non-commercial fan art, or similar non-commercial visual content.
You may not use Editorial products for commercial advertising, paid client work, book covers, merchandise, product packaging, games, apps, commercial comics, commercial videos, or any project intended for sale or commercial promotion, unless the product page expressly gives additional permission.

6. Extended License
The Extended License is required when you want to use a 3D product beyond rendered 2D artwork.
For example, if you want to include a 3D model, texture, morph, preset, or other Product File in a game, app, VR/AR project, interactive experience, simulation, or another distributed project, you need an Extended License or written permission from 3D Shards or the original Seller.
With an Extended License, you may use the purchased product as part of a larger End Product, such as:
- a video game;
- a mobile app;
- a VR or AR experience;
- an interactive project;
- a real-time scene;
- a simulation;
- a virtual production project.
The asset must be included only as part of the final compiled, packaged, or reasonably protected End Product.
Even with an Extended License, you may not:
- sell, upload, share, or redistribute the original Product Files as standalone files;
- give the source files to other people;
- include the asset in a way that allows users to extract, download, or reuse the original files;
- sell the asset as a standalone 3D model, texture pack, morph pack, preset pack, or merchant resource;
- turn the product into a competing asset, model pack, texture pack, morph pack, preset pack, merchant resource, or downloadable 3D product;
- claim that you created the original asset.
If the asset is used in a game or interactive project, you must take reasonable steps to prevent end users from easily extracting, downloading, or reusing the original Product Files.
Not every product automatically includes an Extended License. If Extended License is available, it should be stated on the product page or in the Product Attributes section.

7. All Rights Reserved Content
Some content may be marked as All Rights Reserved.
“All Rights Reserved” means that the creator or rights holder keeps all rights that are not expressly granted to you.
This may apply to certain comics, art packs, wallpapers, promotional images, special downloads, previews, or other creative works.
You may view and use All Rights Reserved content only for the personal purpose stated on the product page, such as using a wallpaper on your own desktop or phone.
You may not copy, upload, share, sell, redistribute, modify, publish, or use All Rights Reserved content in your own projects unless you have written permission from 3D Shards or the rights holder.
If the page does not clearly give you permission to use All Rights Reserved content in a certain way, you should assume that the use is not allowed.
8. Prohibited Uses
Unless expressly permitted by the applicable product-specific license, you may not:
- resell, redistribute, share, upload, sublicense, gift, transfer, or make available the Product Files;
- provide access to the Product Files through file-sharing services, cloud folders, forums, repositories, torrents, Discord servers, or similar platforms;
- include the Product Files in another downloadable product;
- sell or distribute modified versions of the Product Files as a new asset;
- extract textures, models, morphs, presets, materials, or other components and redistribute them separately;
- use the Digital Product to create a competing asset, model pack, texture pack, preset pack, morph pack, or merchant resource;
- claim ownership or authorship of the original Digital Product;
- remove copyright notices, license information, watermarks, metadata, or technical restrictions;
- use the Digital Product in a way that infringes third-party rights;
- use the Digital Product for unlawful, defamatory, abusive, hateful, or otherwise illegal purposes.
9. Sharing Within a Team or Organization
If a Digital Product is purchased by a company, studio, or organization, the Product Files may be used internally by employees or contractors working on behalf of that same organization, but only for projects owned or controlled by that organization.
The organization remains responsible for ensuring that all employees and contractors comply with this Agreement.
Product Files may not be shared with third parties for their independent use. Contractors must delete the Product Files when they no longer need them for the authorized project.
10. Client Work
You may use Digital Products under the Standard License to create permitted End Products for clients, such as renders, animations, videos, illustrations, promotional images, book covers, comics, or similar 2D Outputs.
You may deliver the final rendered or flattened End Product to your client.
You may not deliver, transfer, or give your client the original Product Files or any extractable asset components unless the applicable license expressly allows it.
11. Games, Apps, VR, AR, and Interactive Use
Under the Standard License, you may use rendered 2D Outputs created from the Digital Product in games, apps, websites, videos, visual novels, comics, and other projects.
You may not include the original Product Files, 3D models, textures, morphs, presets, or extractable asset components in games, apps, VR/AR projects, interactive products, downloadable projects, or distributed software unless the product page grants an Extended License or you receive written permission.
If your project requires embedding or distributing 3D files, textures, or other extractable asset components, you need an Extended License or written permission.
12. AI, Machine Learning, and Dataset Use
Unless the product page expressly allows it, you may not use Digital Products or Product Files to train, fine-tune, validate, test, or build artificial intelligence models, machine learning systems, datasets, computer vision systems, or generative AI tools.
You may not include Product Files or extracted components in any dataset, training set, model input collection, or similar data resource.
This restriction does not prevent you from using permitted rendered 2D Outputs in ordinary creative projects, unless those outputs are specifically used to train or build AI or machine learning systems.
13. Third-Party Intellectual Property
Some Digital Products may include or depict third-party intellectual property, brands, logos, characters, designs, locations, or other protected elements.
You are responsible for determining whether your intended use requires additional permissions, releases, or clearances from third parties.
3D Shards and Sellers do not grant rights to third-party intellectual property unless expressly stated on the product page.
14. Free Products, Gift Products, Supporter Products, and Promotional Downloads
Free products, gift products, supporter products, exclusive supporter downloads, and promotional downloads are licensed under this Agreement unless the product page states otherwise.
Downloading a product for free does not mean the product is public domain or free from license restrictions.
You may not redistribute, resell, upload, share, or make available free or promotional Product Files unless the product page expressly allows it.
15. Refunds, Chargebacks, and License Termination
Your license depends on a valid purchase or authorized download.
If a purchase is refunded, reversed, charged back, cancelled, found to be fraudulent, or otherwise invalidated, your license to use the relevant Digital Product terminates immediately.
After termination, you must stop using the Digital Product and delete the Product Files from your devices, storage systems, and backups where reasonably possible.
Refunds, returns, withdrawal rights, and exceptions for instantly downloadable digital products are governed by our Refund and Returns Policy:
Termination does not affect rights that cannot be limited under applicable law.
16. Breach of License
If you violate this Agreement, your license may terminate automatically.
3D Shards or the Seller may require you to stop using the Digital Product, remove infringing content, delete Product Files, and take reasonable steps to prevent further unauthorized use.
We may suspend or terminate accounts that violate this Agreement, our Terms and Conditions, applicable laws, or third-party rights.
17. No Warranty of Compatibility
Digital Products are provided as described on the product page.
We do not guarantee compatibility with every device, operating system, software version, Daz3D version, render engine, plugin, workflow, or user setup unless compatibility is expressly stated in the product description.
Before purchasing, you are responsible for reviewing the product description, compatibility information, technical requirements, included files, and documentation.
This does not limit any rights you may have under applicable consumer protection law if a product is defective or materially different from its description.
18. Limitation of Liability
To the maximum extent permitted by applicable law, 3D Shards, Sellers, and licensors are not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from the use or inability to use Digital Products.
Our total liability for claims relating to a Digital Product is limited to the amount paid for that Digital Product, unless applicable law requires otherwise.
Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law.
